Terms & Conditions

GENERAL TICKET PURCHASES

These apply to Standard, and Gift Tickets. In circumstances where there is a conflict between the terms and conditions relating to General Ticket Purchases and Gift Tickets Purchases, the precedence shall be as follows:

• General Ticket Purchases.

Introduction

1. The organiser is Southampton International Boat Show Limited (company number 01247541, Marine House, Thorpe Lea Road, Egham, Surrey, TW20 8BF), its employees, staff, agents, advisors and representatives (the “Organiser”).
2. The show is the Southampton International Boat Show 2020 (the “Show”).

Admission

3. All tickets prices, discounts, offers and promotions are subject to availability and may be amended without notice. Ticket prices are as stated on the Show website.
4. Visitors will not be allowed admission to the Show without a valid ticket.
5. Presentation of the ticket for Show admission constitutes acceptance of the terms and conditions upon which the Organiser is prepared to grant entry.
6. Upon exit from the Show visitors will not be re-admitted.
7. A ticket is valid for one admission only (unless expressly stated by us). Removal of the stub or any alteration may invalidate the ticket.
8. Tickets containing mistakes cannot be rectified on presentation of the tickets at the Show.
9. No children under the age of 16 years will be admitted access to the Show (even with a valid ticket) without any accompanying adult.
10. Up to two children 15 years and under can gain access to the Show with every standard adult ticket presented. Additional children tickets may be purchased in advance.
11. All children entering the Show must have a ticket.
12. A ticket obtained in contravention of these terms and conditions, or which in the Organiser’s reasonable opinion is being used, or is intended to be used, in contravention of these terms and conditions, shall be void. All rights conferred or evidenced by such a ticket shall be nullified.
13. For public safety the Organiser reserves the right and ultimate discretion to refuse admission to or to eject visitors to the Show or with respect to Show attractions in reasonable circumstances (for example taking health and safety, environmental and security concerns into account), and may on occasion have to conduct security searches to ensure the safety of customers. Customers should note that they may be refused entry or ejected from the venue on account of being (or appearing to be) abusive, threatening, or drunken, declining to be searched, carrying offensive weapons or illegal substances or for any other anti-social behaviour. Determination of such shall be at the discretion of the Organiser.
14. Each customer admitted to the Show enters the Show at their own risk.

Promotional & Discounted Tickets

15. Promotional or discounted tickets cannot be used in conjunction with any other offer.
16. Tickets shall not be used for any promotion, advertising, fundraising, auction, raffle or other similar commercial or non-commercial purpose including, but not limited to, being awarded as a prize (or part of) without the consent of the Organiser.

Refunds, Exchange, Transfer or Resale

17. All tickets remain the property of the Organiser.
18. No refunds are available on tickets.
19. Tickets cannot be exchanged, or transferred, nor may they be resold for commercial gain.
20. Any replacement of lost, damaged or stolen tickets remains at the discretion of the Organiser.

Right to Cancel, Defer, Rearrange or Amend

21. The Organiser reserves the right to defer, rearrange, amend or cancel the Show in whole or in part or any of its attractions at any time without obligation to refund or exchange tickets.
22. If for any reason the Organiser cannot offer you any feature or attraction at the time or date specified, it will endeavour to offer you a suitable alternative time and/or date during the Show, but it will not be obliged to do so.

General

23. Possession of a ticket does not confer any rights (by implication or otherwise) on you to use, alter, copy or otherwise deal with any of the symbols, trademarks, logos and/or intellectual property appearing on the ticket.
24. Visitors may be filmed and/or recorded for broadcast (which may be live), marketing, Show promotion or security purposes during the Show.
25. Other than for private or domestic use, any ticket holder attending the Show shall not record, use or transmit over the internet, radio, television or any other current or future media, any sound, image, recording or description of the Show without first obtaining explicit written consent from the Organiser.
26. The distribution of leaflets or any other advertising material or the sale of articles anywhere within the Show premises is strictly forbidden without prior written permission from the Organiser; who reserves the right at its absolute discretion to confiscate such articles for infringement of this condition and to eject any individuals who have been doing so.
27. Ambush marketing is strictly prohibited, and anyone caught carrying out such an activity will be evicted from the Show and potentially be subject to prosecution.
28. You must not breach or infringe the rights of any sponsors, suppliers, broadcasters, exhibitors or other parties commercially associated to the Show.
29. Alcohol is only served to those customers aged 18 years and over. Proof of age may be requested at the time of serving alcohol.
30. Alcohol shall only be consumed in the designated areas.
31. Illegal substances will not be tolerated, and the Organiser reserves the right to remove any visitor from the Show if the Organiser believes that they are either carrying or using any illegal substances and the Organiser may report such visitors to the police.
32. Animals shall not be permitted to the Show except for dogs.
33. All damage to property, accidents and injuries incurred at the Show must be reported to the Organiser immediately in accordance with Show health and safety procedures.
34. The Organiser reserves the right at all times to refuse or restrict the use of any facilities and to eject any person refusing to comply with these conditions, or who the Organiser reasonably believes to behave inappropriately in any way, cause damage or annoyance to any other persons or property.
35. A transaction fee of £1.99 will apply to each individual booking transaction.
36. The Organiser reserves the right to change these terms and conditions from time to time.

Limitation of Liability

37. Except for any liability for:
    i) death or personal injury caused by our negligence; or
    ii) fraud or fraudulent misrepresentation; or
    iii) any other liability that cannot be excluded or limited by law;

the Organiser will not be liable, whether in contract, tort (including but not limited to negligence or breach of statutory duty) for:

iv) any damage to property, accidents or injuries incurred at the Show.
v) financial or other responsibility for: 1) any loss or liability incurred by the public at the Show, which arises or may arise as a result of contracts entered into by visitors with any exhibitor or for any advice sought or obtained from any exhibitor; or 2) any loss or damage to personal property brought into the Show.
vi) any indirect, special or consequential losses, including, but not limited to: i) loss of profits; ii) loss of revenue; iii) loss of contracts; iv) loss of data; or v) loss of goodwill.

38. Subject to the above, the Organiser’s total aggregate liability (whether in contract, tort (including negligence) or otherwise) is limited to the purchase price of the tickets that you purchased, or £50 (whichever is the greater).
39. These terms do not affect your statutory rights as a consumer under the Consumer Rights Act 2015.

Entire Agreement

40. These terms and conditions contained in clauses 1 to 48 constitute the entire agreement between the Organiser and any customer and neither party shall have any claim or remedy in respect of any statement, representation, warranty or undertaking, made by or on behalf of any other party in relation to these terms and conditions which is not already set out in these terms and conditions.
41. If any provision or part-provision of these terms and conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these terms and conditions.

Governing Law & Jurisdiction

43. The purchase of any Show Ticket shall be governed by the laws of England and Wales and the parties hereby submit to the exclusive jurisdiction to the English courts.

RYA DINGHY SHOW – TICKET PRIZE DRAW

TERMS AND CONDITIONS

1. The prize is 1x pair of general entry tickets to the RYA Dinghy Show 2020 (the “Prize”).
2. Entries will be accepted from 7pm on 22^nd February 2020 until 8^th March 2020 (“Closing Date”).  Entries received after the Closing Date will not be counted.
3. The promoter of this prize draw is British Marine Federation, company number 2592536, with its registered office at Marine House, Thorpe Lea Road, Egham, Surrey, TW20 8BF (the “Promoter“).
4. The prize draw is free to enter and no purchase is necessary. Participants can enter by completing and submitting their name, e-mail address and postal address on the prize draw landing page.
5. Entry is open to UK residents aged 18 or over, except the employees and family members of the Promoter or those of its group companies.
6. The prize for the winner is non-exchangeable and non-transferable. No entrant can select an alternative prize. The Promoter reserves the right to substitute any Prize with an alternative prize of equal or greater value or to offer a cash alternative.
7. Entry is limited to one entry per email address.
8. The Promoter accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
9. The Promoter will be in no way liable for any failure or inability to contact any entrant via the entrant’s email address given during the entry, or for any other circumstances beyond the reasonable control of the Promoter or otherwise.
10. The draw to determine the winner will take place on or around Friday 28^th February 2020 at 12pm. The winner will be selected at random. The selection of the winner will be final, and no correspondence will be entered into by the Promoter in respect of any decision made. If a winner does not confirm acceptance within 24 hours, or cannot be contacted, the Prize (as applicable) will revert to the next newly drawn email (who has not already won a Prize) and so on. If a winner wishes to reject the Prize (as applicable) in favour of giving it back to the Promoter to re-raffle or auction, he/she may do so.
11. Regardless of whether the Promoter has been successfully able to contact a winner, a winner must communicate to the Promoter his/her acceptance of the Prize to the Promoter within 24 hours of being contacted via email by the promoter. If the winner fails to do so, the Prize will be forfeited and will revert to the next drawn entry under clause 10.
12. The Promoter shall be entitled to delay the draw at any time.
13. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of the winner, to anyone who contacts the Promoter in accordance with condition 14 within one month after the Closing Date. If a participant objects to their surname and county being published or made available, please contact the Promoter. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request
14. All personal data provided by entrants to the Promoter in connection with a the prize draw will be used by the Promoter, its employees, suppliers, contractors and agents to administer the draw, and (if applicable) to inform them of their winning entry and to distribute the Prize (as applicable).
15. The name of the winner is available on request to the Promoter within one month of the prize draw taking place. Details can be obtained be sending a request together with a stamped self-addressed envelope, directed to: RYA Dinghy Show Ticket Competition, Marine House, Thorpe Lea Road, Egham, Surrey, TW20 8BF.
16. The Promoter accepts no liability for errors or omissions contained within the Prize details. It is the responsibility of the winner to satisfy him/herself as to the accuracy of any such details.
17. The Promoter reserves the right: 1) to disqualify any persons whose conduct is contrary to the spirit of the rules or the intention of the competition and to declare as void any or all claims or entries resulting from any printing or production errors; 2) to add or to waive any rules on reasonable notice; and 3) to cancel the competition at any stage in the event of circumstances beyond its reasonable control.
18. Once a winner has accepted the Prize the Promoter will arrange for Prize, to be sent to the winner via the email provided upon entering the competition.
19. The Prize is subject to the additional terms and conditions of the RYA Dinghy Show.
20. If any provision or part-provision of these terms and conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these terms and conditions.
21. The Promoter shall not be liable to any winner in respect of any losses, costs, expenses incurred as a result of the Promoter’s inability to make the Prize available.
22. The Promoter shall not be liable for any costs, losses or expenses incurred by an entrant in connection with this competition, unless required by law.
23. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions
24. These Terms & Conditions shall be construed in accordance with English law and the parties hereby submit to the exclusive jurisdiction of the English courts.

ROOSTER SAILING BUOYANCY AID– PRIZE DRAW
